Solicitor-Client Privilege

When you're dealing with sensitive tax planning or tax dispute issues, the confidentiality and protection of private information and communications can be critical. Lawyers offer Solicitor-Client Privilege which is the protection of your sensitive communication, documents and information.

Information communicated to or through your lawyer on your behalf for the purpose of obtaining legal advice (including tax advice) cannot be disclosed to anyone, including the CRA, without your consent and without Court Order. Accountants do not offer the same protection and their files, their notes and their email communications can be compelled and accessed by the CRA, business associates, spouses and even third parties.

If you are dealing with accountants and advisors on sensitive matters which require confidentiality or if you're an accountant, bookkeeper or advisor who is not a lawyer and are representing clients on sensitive and confidential matters, contact us to discuss how to organize those discussions and materials to properly obtain and maintain Solicitor-Client Privilege.
